1. Acceptance of Terms

By accessing or using Trendr ("the Service", "we", "us", or "our"), operated by Trendr, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, including the mandatory arbitration provision and class action waiver, do not use the Service.

2. Merchant of Record

Polar Software, Inc. ("Polar") is the Merchant of Record for all orders. Polar provides all customer service inquiries and handles returns. By purchasing a subscription or credits, you agree to Polar's Terms of Service.

3. Description of Service

Trendr provides AI-powered tools for content analysis and image generation. We utilize advanced artificial intelligence models to assist users in creating digital assets. You understand that AI generation is an evolving technology and results may vary.

4. Acceptable Use Policy (Strictly Enforced)

You agree NOT to use the Service to generate, upload, or share content that:

• Is sexually explicit, pornographic, or obscene (NSFW content).
• Depicts child sexual abuse material (CSAM) or nudity involving minors. We report all such content to the NCMEC and relevant authorities.
• Promotes violence, hate speech, harassment, or discrimination against individuals or groups based on race, religion, gender, sexual orientation, etc.
• Constitutes "deepfakes" intended to mislead, defraud, or defame others, or to impersonate public figures for malicious purposes.
• Infringes on the intellectual property rights (copyright, trademark, patent) of any third party.
• Promotes illegal acts, self-harm, or terrorism.
• Contains malware, viruses, or malicious code.

Violation of this policy will result in immediate account termination without refund. We reserve the right to monitor content and cooperate with law enforcement.

5. User Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials. You notify us immediately of any unauthorized use. You must be at least 18 years old to use the Service.

6. Payment & Subscriptions

• Billing: Fees are billed in advance. All payments are securely processed by Polar.
• Cancellation: You may cancel your subscription at any time via your account settings. Access continues until the end of the billing period.
• Refunds: Refunds are governed by our Refund Policy.
• Taxes: Polar calculates and collects applicable sales tax/VAT based on your location.

7. Intellectual Property Rights

Your Content: You retain ownership of the content you generate. You grant Trendr a license to host, process, and display your content solely for the purpose of providing the Service.

Our IP: The Service interface, logos, and code are owned by Trendr. You may not copy, reverse engineer, or resell the Service.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not guarantee that AI-generated results will be accurate, unique, or suitable for your specific needs.

9. Limitation of Liability

To the maximum extent permitted by law, Trendr and its affiliates (including Polar) shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid to us in the last 12 months.

10. Indemnification

You agree to indemnify and hold harmless Trendr, Polar, and their officers from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Changes to Terms

We may update these Terms. If changes are material, we will notify you via email. continued use constitutes acceptance.
